ELECTION OF
OFFICERS: Commissioner Smith nominated Commissioner Satorre as
Chair. Commissioner Salamy seconded the
nomination. Moved by Commissioner Salamy
and seconded by Commissioner Smith to close the nominations. Roll call vote on
nominee for Chair was carried unanimously.
Commissioner Kelly nominated Commissioner Kelly as Vice Chair,
Commissioner Tallerico seconded the nomination and it was carried
unanimously.
APPROVAL OF MINUTES: Moved by
Commissioner Tallerico, seconded by Commissioner Salamy, to approve the minutes
of January 2, 2008. Motion carried 5-0.
10. Minor
Subdivision MS07-5, Use Permit UP07-6 and Environmental Assessment to construct
two new duplex units –
Staff report presented by: Michael Van Lonkhuysen, Associate Planner
Mr. Van Lonkhuysen presented the
request by applicant, John Britton to obtain minor subdivision approval to
construct a pair of residential duplexes on a vacant lot. This application is the same application that
the Planning Commission and City Council approved 2005. Because the previous approval expired, the
applicant is required to reapply for minor subdivision and use permit approval.
The site is located on the east side
of
The existing lot is 8,000 square
feet. The proposed subdivision would
result in two new lots with the southerly lot being 3,750 square feet and the
northerly lot 4,250 square feet. The
applicant proposes to construct a duplex on the front portion of the new lots
for a total of four new units. All units
would have access to improved rear yards, which are 1,116 square feet for the
southerly duplex and 1,302 square feet for the northerly duplex.
Each of the buildings would be built
to a zero lot line and would meet all applicable setback requirements. The proposed front yard setback is 18 feet,
while the rear yard setback is 40 feet.
There are no side setbacks. The
project meets all requirements of the Sullivan Corridor Specific Plan and the Zoning
Ordinance.
The ground floor consists mainly of
the garage, where each unit has two spaces and another space in the
driveway. Zoning regulations require
that two parking spaces be provided for each residential dwelling. The applicant is providing three spaces per
unit. Staff has required pervious pavers
for all driveway surfaces.
The approximately 1,500 to 1,600
square foot residential units include three bedrooms and two bathrooms, great
room and a kitchen. The units would be
located at the second and third floors of each building. All units would be accessible by walk-up stairs
which directly access the building exterior and garage.
Staff felt that the architect,
Ronald Perner, did a good job of picking up important architectural features of
the neighborhood, utilizing the hip roof system, gable roof system, drop and shingle
siding and architecturally decorative doors.
As part of the recent Sullivan
Corridor Committee review, the Committee agreed with staff’s concern about the
lack of architectural detail at the building’s side elevations, which are
proposed as plywood. This was primarily
a requirement of the building code.
Prior to January, the code did not allow siding and it had to be plywood,
but now it’s allowed and will be included in this design, as has been required
by the Sullivan Corridor Committee.
Staff has determined that the
project is Categorically Exempt per Minor Land Divisions and Construction of
Small Structures sections.
Commissioner Smith stated that she
understood the minor subdivision part of the application, but wanted to know
what the use permit was for. Mr. Van
Lonkhuysen replied that the Sullivan Corridor Specific Plan required a use
permit for medium-low density residential uses.
Commissioner Kelly commented on the
parcel map used in the presentation and said it was much clearer and easier to
read than the previous ones.
COMMISSION ACTION
Moved by Commissioner Kelly, seconded
by Commissioner Salamy, to close the public hearing. Motion carried 5-0.
Moved by Commissioner Salamy,
seconded by Commissioner Kelly, to adopt the findings as outlined in the staff
report of February 6, 2008. Motion
carried 5-0.
Moved by Commissioner Smith,
seconded by Commissioner Tallerico, to affirm the Environmental Assessment. Motion carried 5-0.
Moved
by Commissioner Salamy, seconded by Commissioner Kelly, to approve Minor
Subdivision MS07-5 and Use Permit UP07-6 subject to the Findings and Conditions
as outlined in the staff report of February 6, 2008. Motion carried by a unanimous roll call vote.
STAFF COMMUNICATIONS:
Commissioner Kelly stated that it
has been a pleasure to be part of the General Plan review and announced that
the first of several public meetings will be held at the War Memorial on
Wednesday, February 13, 2008 from 7:00–9:00 PM.
She encouraged everyone to attend, although Commissioners were not
expected to participate, but to listen to the community and see what they think
because the Commission will be asked to vote on things further down the
line. She hoped residents and business
owners would attend and let everyone know what they want
Senior Planner Mothershead mentioned
that there would be parking available at First National Bank. She also stated that the General Plan Update
has a special website called www.plandalycity.org and that the
survey is also available online and she encourages people to answer the survey
that way to save postage and make tabulation easier.
Commissioner Smith thanked Denise
Kelly for the excellent job she has done this past year and wished Ray Satorre
good luck.
