Initiation of litigation pursuant to Government Code Section
54956.9(c). The City would be the party initiating the litigation; the purpose
is to decide whether to initiate this litigation; and naming the party against
whom such litigation would be directed would jeopardize the City’s ability to
conclude settlement with the party absent direction from the City Council on
