City of Daly City Minimum Wage Ordinance

On January 14, 2019, the City Council of Daly City adopted the Daly City Minimum Wage Ordinance that will increase the local minimum wage to $15.00 by 2021. The local minimum wage will increase at a faster pace than the State of California’s minimum wage schedule. The local minimum wage applies to all businesses and employees that work two (2) or more hours per week within the boundaries of the City of Daly City.

THE CURRENT MINIMUM WAGE IN DALY CITY IS $12.00 PER HOUR. ON JANUARY 1, 2020, THE MINIMUM WAGE WILL INCREASE TO $13.75 PER HOUR. 

Minimum Wage Increase for 2020

Beginning January 1, 2020, Daly City’s local minimum wage of $13.75 applies to all businesses within the geographic boundaries of Daly City and any employee working at least two (2) or more hours per week. The minimum wage applies to all companies that have employees who work in Daly City. An employer may not use tips, or fringe benefits such as health insurance, vacation, sick leave or other benefits to offset or use as a credit towards the employer’s obligation to pay the City’s minimum wage. 

The minimum wage requirement set forth in the City of Daly City Minimum Wage Ordinance applies to adult AND minor employees who work two (2) or more hours per weeks (tips not included). The minimum wage will be adjusted annually beginning on January 1st of each year. Beginning January 1, 2020 the Daly City minimum wage will be $13.75 per hour, January 1, 2021 it will be $15.00, and annually thereafter the Daly City minimum wage will be adjusted based on the Regional Consumer Price Index. 

Under the Ordinance, employees who assert their rights to receive the City’s minimum wage are protected from retaliation. Employees may file a civil lawsuit against their employers for any violation of the Ordinance or may file a complaint with the City of Daly City. The City will investigate possible violations and will require access to payroll records. The City will enforce violations of the Minimum Wage Ordinance by ordering reinstatement of employees, payment of back wages unlawfully withheld and penalties.

What does this mean for EMPLOYERS?

  • Starting January 1, 2020, minimum wage in the City of Daly City is $13.75 per hour. Tips and other benefits may not be considered an offset to the Minimum Wage. 
  • Each employer must give written notification to each current employee and to new employees (at the time of hire) of the employee’s rights under the Minimum Wage Ordinance. 
  • The employer must post the Official Notice prominently in the areas at the work site where it will be seen by all employees. Failure to post such notice will be a violation of the Municipal Code. 
  • Each employer shall maintain for at least three years for each employee, a record of their name, hours worked and pay rate. 
  • Under the Ordinance, an employer may not retaliate against an employee for making a complaint to the City regarding their right to receive the minimum wage specified. The City of Daly City will investigate possible violations and may take enforcement action including reinstatement of the employee, payment of back wages and civil penalties. 

 What does this mean for EMPLOYEES?

  • Starting January 1, 2020, minimum wage in the City of Daly City is $13.75 per hour.
  • Covered employees include anyone who performs two (2) or more hours of work per week within the geographical boundaries of the City of Daly City, including employees who are under 18 years old. 
  • Covered employees are entitled to these rights regardless of immigration status. 
  • The minimum wage will be adjusted annually on January 1st of each year.
